Privacy Policy

Hong Kong Business Aviation Centre is operated by Hong Kong Business Aviation Centre Limited (“HKBAC”, “we”, “us” or “our”).  It is the policy of HKBAC to comply with the Personal Data (Privacy) Ordinance, Cap. 486. We also strive to ensure compliance by our staff with the strictest standards of security and confidentiality.

We safeguard information provided by our customers, guests, visitors, users, flight crews, business partners, contractors, our web app and mobile application (“App”) users and website users (collectively the “User”). With the only exceptions that personal data may be collected in relation to the submission of enquiry online, and the IP address of the computer used to visit our website may be recorded, we do not collect any personally identifiable information from User while they use the App and our website, and no personal data is collected, unless specified. The above information is used only for preparing general statistics on the usage of our App and website.

The collection of any personal data will be subject to our Personal Information Collection Statement. Personal data is stored securely in our system, and we will take all practicable steps to ensure that personal data is not kept longer than necessary for the fulfilment of the purposes (including any directly related purposes) for which the data is or is to be used. Only trained, authorized staff shall have access to the data, and we do not release personal data to parties outside us except as set out in our Personal Information Collection Statement. User has the right to request access to and correction of their personal information in accordance with the procedure set out in our Personal Information Collection Statement.

We may, from time to time, send direct marketing materials promoting services and products to User based on their personal data, but suitable opt-out mechanisms are provided.

We make every effort to protect the privacy of User, but given the nature of the Internet, we cannot guarantee perfect security, especially no information provided over the internet can be guaranteed to be completely secured.

We use third party content and service providers (the “Third Party Providers”) and offers links to third party websites. These Third Party Providers may collect personal data from User, and they adhere to their own privacy policies. Our Privacy Policy Statement and Personal Information Collection Statement do not cover third parties.

Personal Information Collection Statement

This  Personal Information Collection Statement sets out  the purposes for which the information provided by you as a User will be used following collection, what you are agreeing to with respect to our use of such information and your rights under the Personal Data (Privacy) Ordinance, Cap 486. This statement may change from time to time, so please check back periodically. Each time you log in to the App or this website and/or use our services, you agree to be bound by the statement in force at that time.  

1. Collection of Data

User may be asked to provide us with personally-identifiable information such as name, email address, phone number, credit card number, Hong Kong Identity Card number and passport number. This is necessary to provide User with the various services offered by us. You, as a User, are not obliged to supply the data, but if you do not, the services will be unavailable. IP address of the computer used to visit our website may be recorded. 

2. Purpose and Use of Data
Information collected is used for the following purposes:
  1. Providing services – to provide the services you have requested and information relating to such services, and facilitate your travel arrangement;
  2. Identification and authentication – to verify your identity for the purposes of making relevant applications and obtaining clearance, including the preparation of general declarations for inbound/outbound immigration clearance, and  the submission of relevant applications for restricted area access;
  3. Communicating with you – to communicate with you for safety and security purpose and in emergency situations;
  4. Complying with legal and regulatory obligations: to comply with any legal and regulatory requirements  to make disclosure under any application laws and regulations;
  5. Service optimization and analysis: to compile statistics about our User to analyse  facility usage and movement records, to help us optimize terminal operations, manage traffic flow, and continuously improve your overall experience;
  6. Direct Marketing: to provide  updated news, information, facilities, services, privileges and offers  offered by HKBAC from time to time (please refer to section 5 “Use of Personal Data in Direct Marketing”);
  7. Processing billing and payment;
  8. Monitoring the use of the App and website to help its further development;
  9. Operating internal control, resolving disputes, troubleshooting problems and enforcing terms of use;
  10. Conducting researches and/or analysis by HKBAC and/or any of its subsidiaries, affiliates and/or associated companies (“the Group”); and
  11. Any other purposes which the User may from time to time agree.
3. Transfer of Data
Users’ information will not generally be disclosed or transferred to any other party in a form that would identify them except those to parties relevant and reasonably necessary for the purposes stated above, including:
  1. If it is necessary to allow Third Party Providers (such as flight operators and aviation security service providers) to offer and provide the third party services and for purposes directly relating thereto;
  2. If it is necessary to transfer your information to comply with any guideline or guidance of any local or foreign legal, regulatory, tax, government, law enforcement or other authorities, including but not limited to the Immigration Department, Customs and Excise Department and the Airport Authority Hong Kong;
  3. We may transfer or disclose Users’ information to our contractors under a duty of confidentiality to us who provide administrative, telecommunications, computer, cloud hosting, data processing or other services to us in connection with the management, operation and maintenance of our business and system with the purpose of personal data collection;
  4. In the case of payment default or payment dispute, if it is necessary for us to pass your personal data to the relevant third party including but not limited to debt collection agencies or the Group’s legal representatives, any Third Party Providers or any third party involved in a corporate business transaction with the Group for the purpose of debt recovery or verifying the disputed amount;
  5. We may also transfer/exchange/disclose your personal data to or with companies within the Group for internal statistical research and/or analysis;
  6. As required or permitted by law.
These parties may have places of business outside Hong Kong, so information may be transferred out of Hong Kong. Furthermore, due to the international nature of aviation, your information may be transferred to jurisdictions outside Hong Kong for flight clearance, immigration, and operational purposes. These parties have their own privacy policies, and the Group has no control over their use of information, so the Group is not liable for their use of information. Please also see our Privacy Policy Statement which sets out our general privacy policy and practices in respect of our collection, holding and use of your information.
4. Our Commitment to Data Security & Storage

All personal data we collect  is stored on our or our subcontractors’ secure servers. We comply with our security policies and standards when accessing or using this information and restrict access to your personal data to those persons who need to use it for the purpose(s) for which it was collected.  We use a range of physical, electronic and managerial measures to ensure that we keep your personal information secure, accurate and up to date.

 

All personal data that has been collected from you will only be stored for a limited duration that is relevant to the purpose for which it was processed and for as long as required by applicable law.

5. Use of Personal Data in Direct marketing

We intend to send you HKBAC’s updates and promotion offers periodically. We intend to use all information provided by you as a User including your name, contact details and all other information which may assist us to understand the services and products which you might be interested in, for delivering the aforesaid information and conduct direct marketing via email, app push notifications, SMS, telephone calls, instant messaging app messages, such other means of communications that you may provide to us, or such other means of communication supported by your mobile phone or device, in connection with our services and products. We also intend to, and in this regard you consent to, transfer and provide the above mentioned information to the subsidiary and/or associated companies of the Group and the Third Party Providers through whom the Group’s and / or third party’s products, facilities, services, privileges, benefits or advantages are provided inside and outside Hong Kong for the said purpose. We may not so use or provide the said information unless we have received your consent. Your consent may be communicated to us without charge at the time when you provide such information through our website or by sending an email to [email protected].

6. Access to Data

7. Links to Other Websites

The HKBAC website, web service, and  the App may contain links to other websites that are operated by third party companies with different privacy practices. You should remain alert when you leave our system and read the privacy statements of other websites. We have no control over personal data that you submit to  these third parties.

8. Use of Cookies

Cookies help us to provide you with a better website service by enabling us to deliver content to you.   By using our website, web service and/or the App, you agree that we can place cookies on your device as described in this Privacy Policy.  We use necessary cookies on the HKBAC website, web service and the App which are essential to access various features and ensure you get the best experience on our website and system.  We may collect information about your computer, including your IP address, operating system and browsing activities. They will help us comprehend how Users engage with the website or system, leading to better performance and enhanced User’s experience.  This is statistical data and does not identify any individual. 

We also use session cookies for various functions, such as signing in, which enable us to track User’s activity during a browser session. A browser session begins when you open the browser window and ends when you close the browser window. Session cookies are created temporarily and are deleted once you close the browser.

You can configure your web browser to either disable cookies or to be informed if a cookie is set.  Please note that some of our services may not function optimally if cookie usage is disabled.

9. Revision and Changes to our Privacy Policy
We may periodically update our Privacy Policy when required.  We reserve the right to change this Privacy Policy without advance notice.  The latest version of our Privacy Policy will  be available on our website with the revision date located hereafter.

Personal Information Collection Statement
(For Recruitment)

1. The personal data provided by you as the applicant will be used by the Hong Kong Business Aviation Centre Ltd. (“HKBAC”) to assess your suitability for the applied and or/any other suitable position within the Company

2. Your personal data held by HKBAC will be kept strictly confidential and only disclosed to the authorized persons within HKBAC for processing the application

3. Under the Personal Data (Privacy) Ordinance, you have the right to request access to, and to request correction of, your personal data held by HKBAC. Such request should be addressed to the Human Resources Manager in writing to: HKBAC, 12 South Perimeter Road, HKIA, Lantau, N.T. HK

4. Under the Personal Data (Privacy) Ordinance, HKBAC has the right to charge a reasonable fee for the costs related to your data access request.

5. If you have not been contacted by HKBAC within 6 weeks from the application submission date, you may assume that your application has been unsuccessful. All personal data will be kept for a period of 6 months from the application submission date and will be destroyed afterwards.
